There are many things that can be disputed about between neighbours, and trees are no exception. Maybe your neighbours’ tree is overgrown and hanging over your property, blocking sunlight or dropping leaves and debris. Let’s go over the best way to get through this situation.

 

If the overhanging tree is causing damage to your property (i.e. hitting a fence, branches touching your house) or is a hazard (i.e. dead or dying branches and trees), your neighbour is responsible for dealing with this issue.

 

If the overhanging tree is not causing damage to your property but you want it trimmed anyhow, you can have it trimmed as long as it will not damage or kill the tree. Your neighbour is not responsible for the costs of this; however, it is recommended to speak with your neighbour before moving forward to avoid unnecessary conflict.

 

If the tree is right on the property line, that means you and your neighbour share the tree and are both responsible to keep it maintained and will both be responsible for management if it becomes hazardous.
